Gears of War 3 appears to have been prematurely announced by Microsoft via an advert which appeared briefly on the XBL dashboard.

The ad, captured by Kotaku, bears the words: "Gears of Wars 3 Announced: The epic story concludes April 2011".

Epic's Cliff Bleszinski had been expected to announce the game while appearing as a guest on the Jimmy Fallon show yesterday, however his appearance was subsequently put back until next Monday - a reschedule that apparently wasn't picked up on by Microsoft.

Microsoft has filed a suit against UK-based gaming accessories company Datel. The company claim that Datel's third-party “TurboFire” and “WildFire” Xbox 360 controllers infringe upon Microsoft-held US patents.

Xbox 360 LogoThe complaint, filed in Seattle on 1 April, lists six alleged patent infringements, referred to as either “Portion of a Game Controller” or “Portion of a Game Input Device Having an Illuminated Region.” The document goes on to state that Microsoft are seeking “compensatory damages” as well as “... total profit from the infringing products, together with interest and costs.”

In a statement, Microsoft spokesman Kevin Kutz referred to the company’s “robust licensing program” and their “... responsibility to protect that program and the companies that are part of it, as well as our own intellectual property.”

This is not the first time Microsoft and Datel have clashed. The legal dispute over a Microsoft update rendering Datel’s third-party Xbox 360 memory cards useless is still ongoing.
