A survivor of the recent shooting at a Madden gaming tournament has filed a lawsuit against Electronic Arts and is seeking damages.
Jacob Mitich was shot twice during the incident, and is now taking legal action against the Madden publisher, the Chicago Pizza venue where the tournament was held, the Jackonsville Landing mall that contained the venue, and five other defendants, Kotaku reports.
The lawsuit does not specify the amount Mitich is claiming, but the claimed centre around negligence, stipulating that the venue was unsafe and that EA "failed to provide a safe and secure environment" for those taking part in the tournament.
A statement was released alongside the lawsuit from James Young, an attorney with personal injury law firm Morgan & Morgan. In it, Young claims Mitich "trusted the event host and organisers, and believed that he was walking into a safe space."
"That trust was shattered when shots rang out in an over-crowded, since-shut-down, non-permitted space," Young continued. "Combined with an alleged abject failure to provide adequate security, the result was tragic."

Electronic Arts has set up the Jacksonville Tribute fund support the victims of last week's mass shooting during a Madden NFL qualifying tournament in Jacksonville, Florida.
The official EA Madden Twitter account announced today that the publisher will also be donating $1 million towards the relief fund.
Contributions will go towards supporting the victims, including the families of tournament competitors Taylor Robertson and Elijah Clayton, who were killed in the shooting.
"The events last weekend in Jacksonville will impact the gaming community forever," reads the statement.
"We can't begin to understand the pain so many are going through, nor do we pretend to have all the answer that will help us through the healing process.
"But as is so often the case, our community inspires us. The way you are coming together, and the outpouring of support for all those affected by this tragedy, is incredibly uplifting. We want to join you."

European games ratings board PEGI has announced it will add warnings about in-game purchases to boxed games in the coming months.
A new descriptor, pictured below, will be included in the information on the box of any title that offers the possibility of further spending after purchases - for example, on booster items or loot boxes.
PEGI notes it already uses such a descriptor for digital-only games via the IARC (International Age Rating Coalition) system, but will now ensure these also appear on the packaging of physical releases. This is expected to come into effect by the end of the year.
<figure class="small"></figure>It's a move that follows last year's controversy over loot boxes and other titles that gave players the option to spend real money on random virtual items - a trend that has since prompted authorities to question whether such mechanics constitute gambling.

The NPD Group has reported US consumers spend $19.5 billion on video game products in the first six months of the year.
This marks an increase of 40 per cent when compared to spending across January to June 2017, with strong growth seen in hardware sales. In fact, first-half spending on hardware was the highest in seven years, rising 21 per cent year-on-year to $1.7 billion.
The NPD highlighted particularly strong sales for Xbox One as well as plug and play devices such as Nintendo's NES and SNES Classic Editions - something that has been a running trend in the firm's recent monthly reports. NES Classic was actually the biggest selling device in June.
However, the majority of revenue still goes on the games themselves. Spending on video games content - which includes full game sales, subscriptions, DLC and microtransactions across PC, console and mobile - rose by 43 per cent year-on-year to $16.9 billion.

After eight weeks in a row on the top of the UK charts, Crash Bandicoot: N. Sane Trilogy has finally dropped to the No.3 spot due to the releases of both F1 2018 and Shenmue I and II.
The two new releases debuted in the No.1 and No.2 spots on the all-formats chart, respectively, with Grand Theft Auto V and Mario Kart 8 Deluxe dipping slightly again down to No.4 and No.5.
World of Warcraft: Battle for Azeroth, which last week took the No.3 spot on that chart, is now nowhere to be found on either all-formats or the individual platform charts (where it reigned at No. 1 last week). It is, however, still No.1 on the PC platform chart.

Both Tomb Raider and Rise of the Tomb Raider have seen a dramatic resurgence in the EMEAA combined charts ahead of the release of Shadow of the Tomb Raider.
Rise of the Tomb Raider rose over 300 places to No.5 on the combined platform-aggregated charts last week, while Tomb Raider took the No.10 spot after spending last week all the way down at No.307.
The remainder of the top 10 should be fairly unsurprising, with Grand Theft Auto V, Tom Clancy's Rainbow Six Siege, and Monster Hunter: World occupying spots 1, 2, and 3. Star Wars: Battlefront II came in at No. 4, surging from its spot at No.30 the previous week ahead of its upcoming Clone Wars DLC, Elite Corps.
The GSD EMEAA charts are a fairly recent initiative from ISFE and B2boost. The charts are not a complete picture: the UK won't contribute data until early next year, and a few major companies such as Bethesda and Nintendo are conspicuously absent from those contributing data.

Today, a Madden NFL 19 gaming tournament took place in Jacksonville Florda. Sadly, it appears a shooting occurred at the event, leading to four currently confirmed deaths. One of the competitors, Drini Gjoka claimed that they fled the area, and was grazed by a bullet while the shooter was active. Jacksonville's Police Department have stated that a shooting did happen, but have not explained any further details at this time, while also telling citizens to stay away from The Landing, where the tragedy took place. The tournament was a qualifier event, which was officially backed by EA Sports. At the time of writing, there are a total of 11 victims. A potential suspect was found dead at the scene.

Most dedicated PC gamers are familiar with the name GOG, otherwise known as Good Old Games, a digital game retailer owned by the company behind the Witcher series of games, CD Projekt. They're renown for selling games with no form of DRM whatsoever, believing that once you buy a game, you should be free to fully own it, rather than being bound by anti-piracy measures.
This stance has brought GOG to its latest attempt to inform gamers: the "FCKDRM initiative".
A new site, made by CD Projekt has gone live, called fckdrm.com, tries to advocate the public against all forms of DRM, claiming them as not only anti-consumer, but that they can also act as a "kill switch" that could easily prevent owners from accessing their purchases.

The site then lists problems with media that has DRM, such as the inability to have offline access or a loss of consumer rights, as well as being a roadblock in terms of digital preservation.

At the bottom of the page is a list of causes to support, such as non-profit companies Defective By Design, which focuses on showing the failures of DRM in different forms, as well as the Electronic Frontier Foundation, who try to lobby and fight legal battles against companies who try to force DRM upon their users. Last reporting month in June, the return of the NES Classic Mini Edition outsold the Switch, Xbox One, PlayStation 4 combined, but this month of July, during what is basically a 'slow month' for new games to be released, the Nintendo Switch returned to the #1 spot!

“Nintendo Switch was July’s best-selling hardware platform in both dollars and units sold,” said Piscatella. “This is the seventh month that Switch has led in hardware dollar sales since launching in March 2017, and the first since December 2017.”
It wasn’t just the Switch that did well for Nintendo, though. In June, the NES Classic Edition outsold all other consoles in terms of units, and both it and the Super Nintendo Classic did well in July as well. Piscatella credits both of them for helping to boost July’s hardware revenue to $217 million, which is up 19 percent year-over-year.
When it comes to hardware, Nintendo is doing the best it has done since 2009, which was in the heart of the Wii and DS lifespans.
But as we’ve grown used to here, just because Nintendo is doing well, that doesn’t mean anyone else is stumbling. Both Microsoft and Sony are in strong positions.
“For the 2018 year to date period, hardware spending has increased 21 percent to $1.9 billion,” said Piscatella. “Spending gains for Xbox One, PlayStation 4, and Plug N Play devices such as NES Classic Edition and Super NES Classic Edition have driven growth. Year-to-date hardware spending is at its highest level since 2011.”
Xbox One hardware is also up 60 percent year-to-date over 2017, and PlayStation 4 is still the top-selling console platform of 2018.

EmuParadise is a ROM download website that until very recently, hosted downloads for games and BIOSes of older consoles such as the PSP, NES, SNES, Genesis and many others. However, this changed with a recent announcement that shook the website to its core.
Yesterday, EmuParadise, which has been online for 18 years, announced that the website’s going to start following a different path; that is a path without hosting retro ROM and BIOS downloads. This decision came due to the fear of legal action being taken against the website which could potentially lead to disastrous life-changing consequences for those who run the site.

It is possible that EmuParadise stopped serving ROMs because of Nintendo’s lawsuit against Jacob Mathias, the owner of LoveROMs and LoveRETRO. In that lawsuit, Nintendo is suing for $100 million which is a enormous sum of money that ROM websites, being mostly run by hobbyists, can’t afford to pay.

The publisher behind Grand Theft Auto has won a US court case that will prevent players from cheating in its online game.
The case centres around Georgia resident David Zipperer, who has been accused of selling software that enables GTA Online users to alter the game or manipulate its mechanics to give them an edge over other players, Reuters reports.
Take-Two claims that not only has this enabled 'griefing' of its online community, it has also cost at least $500,000, according to a complaint filed back in March.
Yesterday, US District Judge Louis Stanton of Manhattan awarded the publisher a preliminary injunction that prevents Zipperer from selling his software. In the ruling, he said Take-Two was likely to prove that Zipperer had infringed its copyright and that his programs cause irreparable harm to the game's sales by discouraging consumers from buying it.

Online video game rental service Gamefly will be shutting down its streaming subscription service at the end of August. Its physical services for game discs sent through the mail will remain unaffected.
Variety reports that the final day of the service will be August 31, after which time accounts will no longer be charged and streaming games will no longer be available.
EA purchased Gamefly's cloud technology back in May, acquiring the company's Casesarea, Israel team and the technology behind the streaming service. Shortly after at E3 2018, EA announced its own streaming subscription service, Origin Access Premier, which went live earlier this week.
However, EA says that its acquisition was unrelated to the end of Gamefly streaming services. "We acquired the team in Israel and the technology they've developed, we did not acquire the Gamefly streaming service," said a spokesperson. "We have not been involved in any decisions around the service."

For UK games retail, we are at the height of the summer drought - with no Amazon Prime Day to lift the market this week.
That means yes, for a fifth week, Crash Bandicoot is No.1. The game returned to the top a year after its initial PS4 release due to new versions for Xbox One and Nintendo Switch.
LEGO The Incredibles is No.2 for a third consecutive week, while The Crew 2 continues to stage a small comeback, rising up five places with a 34% improvement in sales. GTA V also returns to the Top Ten, jumping 11 places to No.7. The game often performs well after a boost in console sales, which occurred during Amazon Prime Day.
A major expansion to No Man's Sky sees that game also return to the Top 50 at No.12.
There were a few smaller new releases, namely Train Sim World by Maximum Games (No.20), Go Vacation on Switch by Nintendo/Bandai Namco (No.23), The Persistence by Sony for PS4 (No.34) and Nintendo's Wario Ware Gold on 3DS (No.38).
August is a generally weak month for new game launches, although there are a couple to keep an eye on - such as Team17's Overcooked 2, Sega's Shenmue 1 and 2, Codemasters' F1 2018 and Rebellion's Strange Brigade. September is when the market will pick up significantly, with game launches such as Spider-Man, Tomb Raider, Spyro and FIFA.

A new ruling in Germany will significantly affect the way pre-orders are handled in the country.
The Higher Regional Court of Munich has banned retailers from offering pre-orders for products without a solid release date, according to German news site Heise (confirmed by the Eurogamer.de team).
The ruling follows a consumer protection claim against leading German electronics chain Media Markt over pre-orders for a smartphone, but now applies to all products - including video games.
This means store must be able to offer customers a latest date by which their purchase will arrive. They are no longer allowed to pre-sell products with a "coming soon" or "available soon" placeholder.
Düsseldorf Consumer CEO Wolfgang Schuldzinski said: "When consumers order goods on the internet, providers must specify by when the goods are delivered."
This will have a noticeable impact on video games as publishers regularly announce new titles without a concrete release date and retailers begin offering pre-orders almost immediately. Germany is a sizeable European market, and therefore likely a good indicator of demand for publishers when targeting the region.

For a third week running, FIFA 18 remains at top of the European charts both digitally and at retail.
The latest European charts from Game Sales Data show that FIFA 18 sales have continued strong, buoyed by excitement around the football world cup.
At retail, God of War is up from No. 3 to No. 2, while Gran Turismo Sport jumped from No. 9 to No. 3.
Despite releasing nearly five years ago, Grand Theft Auto enjoys yet another week in the top ten, coming in at No. 4 up from No. 6.
Meanwhile, Far Cry 5 continues it steady sales remaining at No. 5, while Mario Kart 8 Deluxe has jumped from No. 10 to No. 6.
Donkey Kong Country: Tropical Freeze has stayed at No. 7, whereas Detroit: Become Human has fallen from No. 4 to No. 8.

Nintendo claimed the top spot in the UK retail charts last week, as Mario Tennis Aces made its debut in first place.
Mario Tennis Aces was one of three Switch games to enter the Ukie Gfk all-formats top 40, the others being Flashback: Collectors' Edition at 26 and Minecraft at 21 - the latter received a pointed video ad about cross-play between the Switch and Xbox One versions, highlighting the absence of PlayStation 4.

I watched Russia Slaughter the first openents and in front of me tonight they are doing a great job of battering egypt 3-0 at the 62 minute stage, are they doing well against poor teams or are they doing well because of playing at home , can they win the world cup??
